Labour Relations Act 2007

What are employee’s rights of freedom of association?

The Act Provides an employee right to:-

• Participate in forming, joining or withdrawal of membership from a trade union
• Participate in a trade unions lawful activities
• Participate in election of the trade union officials and representatives
• Stand for election and be eligible for appointment as an officer or official and to hold office
• Stand for election or seek appointment as a trade union representative and if elected or appointed to carry out functions of the trade union
• Participate in a Federation of Trade Unions lawful activities, election of any of its office bearers or officials and stand for election or seek for appointment as an office bearer or official and if elected or appointed, to hold office.
• An employee who is a member of trade union is protected against discrimination in employment

Employment Act 2007

What deductions can an employer make from the wages of an employee?

An employer may make deductions from the wages of his employee  for the following:-

• Contribution to any provident fund or superannuation scheme
• Reasonable amount for any damage, loss or property lawfully in his possession or custody
• Over absence from duty without lawful cause
• Any amount paid to the employee in error as wages in excess of the amount of wages due to him.
• Any amount the deduction of which is authorized by written law.

Labour Institutions Act

What is the Labour Administration and Inspection Agencies?
• These include the Labour department and other public agencies which have enforcement responsibilities for this act or any other act of Parliament on matters relating to labour and employment
• Key administrators provided for in the Act are the  Commissioner for Labour, the Director of Employment and Registrar of Trade Unions.
