PUBLIC PARTICIPATION ON THE NATIONAL LIST OF HAZARDOUS WORK PROCESSES FOR PERSONS UNDER THE AGE OF EIGHTEEN (2025)

The Directorate of Occupational Safety and Health Services in the State Department for Labour and Skills Development, in conjunction with the International Labour Organization (ILO) invite the public to provide input on the proposed National list of hazardous work processes for persons under the age of eighteen.

The proposed list is in pursuant to section 97 of the Occupational Safety and Health (OSH) Act 2007, ILO conventions C138 – Minimum Age Convention (1973) and C182 – Worst Forms of Child Labour Convention (1999).

The proposed hazardous list aims to support Kenya’s implementation of ILO Conventions C138 and C182 by presenting an updated Hazardous Work List for children that reflects the current labour market conditions, occupational risks, and emerging forms of work, including digital platforms. It seeks to align national legislation with international standards, promote legal and institutional reforms, and enhance enforcement mechanisms. The list reinforces Kenya’s commitment to protecting children from hazardous labour and ensuring their safety, rights, and development across all sectors through stakeholder engagement, public awareness, and continuous monitoring.

All stakeholders including the Tripartite Partners, Employers Workers, Children Protection Actors and members of the public are hereby requested to submit their views on the draft proposed list in the prescribed format. It can be downloaded from https://labour.go.ke/publications.
